Acceptable Use Policy - Quick Summary

At Arcustech, we’re committed to providing a secure, reliable hosting environment for all customers. To keep our network safe, fast, and fair for everyone, we ask that you follow these guidelines:

  • Be lawful and respectful: Don’t engage in illegal activity, harassment, or abuse of our network.
  • Protect privacy and security: Access only what you’re authorized to, and keep your sites, scripts, and applications up to date.
  • No spam or mass unsolicited email: All bulk email must be opt-in and include an easy unsubscribe option.
  • Responsible testing only: You may run PCI scans on your own VPS and hire pen testers for your own applications, never against others or Arcustech’s infrastructure.
  • Respect content standards: No illegal, abusive, or infringing content is allowed.
  • Use resources appropriately: Storage and IP addresses must be used only for your hosted websites and services.

Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) is incorporated by reference into Arcustech, LLC’s Master Service Agreement (“MSA”). Your use of Arcustech’s Services is subject to this AUP, and any violation of this AUP may result in suspension or termination of Services in accordance with the MSA.

1. Prohibited Uses

You may not use Arcustech’s network or Services to engage in, foster, or promote illegal, abusive, or irresponsible activities, including but not limited to:

  • Unauthorized access to or use of data, systems, or networks...
  • Monitoring data or traffic without express authorization...
  • Interference with service to any user...
  • Use of an Internet account or computer without authorization...
  • Collecting or using email addresses, screen names, or other identifiers without consent...
  • Use of any false, misleading, or deceptive TCP/IP packet header information...
  • Distribution of software that covertly gathers or transmits user information...
  • Distribution of advertisement delivery software without proper consent and uninstall method...
  • Activities violating lawful privacy rights, publishing defamatory statements, or harassment...
  • Any conduct likely to result in retaliation against Arcustech’s network or staff...

2. Email Usage and Bulk Sending Policy

Arcustech services are designed primarily for web hosting, application hosting, and related services. This applies to both managed and self-managed VPS environments.

Limited use of system mail functions such as sendmail, PHP mail, or outbound SMTP (port 25) is permitted for normal application-level needs, including transactional emails and low-volume notifications.

Use of any Arcustech service for bulk email, mass mailing, or unsolicited email activity is strictly prohibited.

ANY abuse reports, blacklisting events, or indications of bulk email activity will be treated as a violation of this policy. Arcustech reserves the right to immediately restrict or disable outbound email capabilities, including blocking port 25, without prior notice.

Repeated violations or severe incidents WILL result in account suspension or termination.

Clients requiring bulk or marketing email capabilities should use a dedicated third-party email delivery provider.

3. Vulnerability Testing

You may not test Arcustech’s systems or networks without express written consent.

Permitted Testing Exceptions:

  • PCI compliance scans against your own VPS and assigned IPs.
  • Third-party penetration testing strictly against your own web applications installed directly on your VPS account.

Testing must not disrupt normal operations or affect other customers.

4. Social Media, Chat Forums, and Other Networks

Follow the rules of any forum, chat group, or social media platform you use. No mass postings or off-topic commercial messages.

5. Content Restrictions

You may not publish or transmit content that Arcustech reasonably believes:

  • Promotes illegal pornography, excessive violence, or hate speech...
  • Is unfair or deceptive under consumer laws...
  • Is defamatory, violates privacy, or risks safety...
  • Discloses trade secrets without permission...
  • Infringes on intellectual property rights...
  • Promotes illegal drugs, gambling, arms trafficking...
  • Is otherwise illegal, malicious, or fraudulent...

6. Copyrighted Material

You may not use Arcustech’s network or equipment to copy copyrighted material unless authorized by the owner or permitted by U.S. law. Arcustech may terminate the Services of infringers.

7. Additional Obligations

  • Maintain valid contact info with your domain registrar.
  • Keep all scripts and web applications secure and up-to-date; you are responsible for impacts caused by outdated/insecure applications.
  • Use only IPs assigned to you by Arcustech.
  • Do not use storage for off-site backups unrelated to your hosted site(s) or for duplicate backups Arcustech already provides.

8. Consequences of Violations

Arcustech may charge its then-current hourly rate (currently $275.00) plus the cost of equipment/materials to:

  1. Investigate suspected violations.
  2. Remedy harm caused by violations.
  3. Respond to subpoenas or third-party information requests.
  4. Remove Arcustech’s IP addresses from abuse databases.
  5. Investigate, respond to, and remediate issues caused by a customer’s failure to keep their website/web applications updated and secure in a timely manner. This includes identifying compromised accounts, isolating infected files, and restoring services; however, cleanup, updates, and securing of applications remain solely the customer’s responsibility.

No SLA credits will be issued for service interruptions resulting from AUP or MSA violations.
