DMCA Quick Guide

We take copyright protection seriously. This guide explains, in plain language, how to submit a valid DMCA request to Arcustech, LLC. For the full legal policy, see DMCA Takedown Policy below.

1) What is the DMCA?

The DMCA is a U.S. law that allows copyright owners to request removal of allegedly infringing content. Hosting providers like Arcustech must respond to valid takedown notices.

2) Before you contact us
  • First try contacting the website owner directly (check the site footer or contact page).
  • If that fails, you may submit a DMCA request to us as the hosting provider.
3) What your request must include

Your DMCA notice must contain all of the following:

  • Your full name, mailing address, and email address.
  • A clear description of the copyrighted work you believe is being infringed.
  • The exact URL(s) or server location(s) of the allegedly infringing material on our systems.
  • A good-faith statement: “I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  • An accuracy/authority statement: “The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner.”
  • Your physical or electronic signature.

5) What happens next
  1. We review your notice for completeness.
  2. If valid, we expeditiously remove or block access to the material and notify the site owner.
  3. The site owner may submit a counter-notification if they believe there’s been a mistake or misidentification.
  4. If you do not initiate court action after a counter-notice, the material may be restored.
Important
  • Incomplete or invalid requests may be rejected.
  • Each incomplete/improper DMCA request may incur a $200 USD processing fee.
  • Misuse of the DMCA can have legal consequences. Submit only accurate, good-faith claims.

Formal DMCA Takedown Policy

Arcustech, LLC does not undertake to examine, monitor, or review messages, files, or other materials that are accessible through, pass through, or reside on our servers or storage systems.

In compliance with the Federal Digital Millennium Copyright Act (DMCA), Arcustech, LLC has designated Nevin Lyne as the authorized agent to receive notifications of alleged copyright infringement occurring on any Arcustech, LLC servers or storage systems.

If you believe your copyrighted work is being infringed by material hosted on Arcustech, LLC’s servers or storage systems, and you wish to avail yourself of the protections of the DMCA, you must provide a signed written notice to our designated agent containing the following:

  • Specific identification of the allegedly infringing material.
  • The exact location(s) or URL(s) on Arcustech, LLC’s servers or storage systems where the material is located.

While Arcustech, LLC does not endorse or affiliate with DMCA.com (a private, paid service provider and not a governmental entity), their publicly available resources can help you prepare a proper DMCA request. In particular, the section titled “What do I need to file a DMCA Request?” outlines the details required for a valid submission.

As they also note in “What kind of websites will process DMCA Requests?”, the preferred initial step is to contact the website or page owner directly. If that does not resolve the matter, you may then submit the request to us, as the hosting provider for the allegedly infringing site.

Our Process Upon Receipt of a Valid DMCA Notice

  1. We expeditiously remove or block access to the allegedly infringing material.
  2. We notify the person who posted the material.
  3. If we receive a counter-notification from that person claiming the material was removed due to mistake or misidentification, we will forward a copy to you.
  4. Unless you notify us of court action to restrain the alleged infringement, we will restore or re-enable access to the challenged material.

Important Notice Regarding Improper Submissions

Each submission of an incomplete or improper DMCA takedown request may be subject to a $200 USD processing fee to cover administrative review time and communication with the submitter. Failure to remit payment for such fees may result in additional charges and collection actions.
